gold coast australia beachThis is a bit of a convoluted question, so I'll start at the beginning. In 2005 my husband(UK citizen, I'm a US citizen) was arrested for domestic violence. At that time, he had been overstaying his visa waiver for about 9 months, as we had been meaning to file his request for permanent residency, but had been lazy and put it off. Anyway, since he overstayed, USCIS took him to a detention center, where he stayed for about a month, and one day they just told him he was going home, they bought him a plane ticket, and sent him on his way. He never received any papers of any kind, all that happened was that his A-number was written in his passport. One of the agents told him he'd have a 3 year ban, another told him it would be 10 years. So, anyway, it's 4 1/2 years later, and we've started trying to find out when he could possibly re-enter, just to visit(we both live in the UK now, but still have family in the States). From what we read, we realized that maybe he wasn't actually technically deported. We called EIOR and found out that his A-number isn't in their system, so obviously he wasn't actually deported. The woman there said it sounds more like an expedited removal. We tried asking ICE what the length of his ban is, and they said we'd have to file a FOIA to find that out. So, until we do that, we're going with the working theory that it's a 5 year ban, since that seems to be what you get for expedited removals. Anyway, if it does turn out to be a 5 year ban, he'd be able to return in a few months, which would be awesome, but we're wondering what the chances of getting approved for a B-2 are. Also, assuming they let him visit, what are the chances of him ever getting a spouse visa, so we could one day move back to the US? Thanks!

Gold Coast, QueenslandMy PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.
My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?

I received I485 receipts from my lawyer, they are missing my priority date which is in sept 2002. Not sure why they are missing..
Did any one come across the same situation....

The PDs are missing in our RNs also. I guess thats the std.

Gold Coast Holidays AtWell, everyone should be proud of IV's great volunteers too who have always proved their consistent success from time to time - though big sucess yet to come! As these volunteers are just like one of us who are working full-time in their job and contribute to IV as and when they can - but I always felt that IV is managed by bunch of full-time professionals with so efficient and accurate manner! Their leading efforts to solve legal immigrant's problems are really commendable!! We are equally graced with great IV members who contributed $$ generously every time (and hope they will keep continue) and helped other way too (e.g. live update of senate sessions, news links, new immigration bills, etc...).
Thanks to everyone. Really proud of being IV member. United we stand!

I don't know about any of those lenses from personal experience, but for what it's worth, Bj�rn R�rslett rates the f/4 version at 2.5 out of 5 (on a D1x, which is similar in resolution to the D70), and doesn't have much praise for its image quality. I'd guess that the f/4-5.6 versions, being newer designs, should be better.

My confusion is, as soon as I enter on AP I am on EAD and I don't have approved EAD. Does this mean I can not work untill I get EAD approved? I don't have Visa Stamped and I am not planning for Visa Stamping.
you can still continue on H1B (same employer) as long it is validity..even when you use AP at POE..

What happens at POE ? We both have valid h1 and h4 stamping but no AP. are we allowed to re-enter on H1 and H4 ?

At embassy/consulate, for visa stamping, you should keep it as they may like to verify. It is not mandatory but good to have.

PG 77 Board Riders, Palm Beach, Gold Coast QLD AustraliaI obtained an H1B visa through Company A (starting October 2008) and the H1B visa was valid until September 2011, unfortunately in March 2009 I was laid off. As a result to maintain my status I switched from an H1B visa to a B1/B2 visa. I actually went to my home country and got the visitors visa from the consulate in my home country. In July 2009 I returned to the USA and entered the USA as a visitor on a B1/B2 visa.
My question now is what happens if I obtain employment. What does my new employer have to do? Since my initial H1B approval is valid until September 2011, can by new employer just take over the H1B without me having to go through the lottery system again even though currently I am on a visitors visa and have been unemployed for more than 3 months?

On the Gold Coast you will140/485 concurrent applied aug 17, 2007 at NSC. PD May 2007 EB3 India.
I am with same H1b employer though now on EAD...h1 expired as PERM not applied until 6th yr h1b, so had no option.
As most know, NSC concurrent 140's will be taking forever to be processed. I have no hope for approval anytime soon. Actually I am expecting a RFE or NOID (hope not) because my labor cert approval was not submitted with my 140/485 due to timing of PERM approval and July fisasco deadline...i am lucky i still got receipt and EAD/AP.
My question...I'm basically miserable at my job. My employer is idiot who's making life difficult. I want to change jobs. I know it's very risky with 140 not approved.
1) can i invoke ac21 since 140/485 pending over 180 days? And if I can, what happens if employer revokes pending or approved 140?
2) With AC21...occupational outlook code is most important? Job title? or job responsibilities? I am looking to try and change what i'm doing...the job code is the same...the titles are somewhat different...and so are the job responsibilities...however it's same job code.
Please suggest....I don't think I can take any more with my employer.

My I-140 was sent on July, 28th to TSC. I did not yet receive any receipt number. How long does it take to get the receipt number once I-140 is applied?

Maybe the EXIF data will be helpful though it's not completely accurate, even though I shoot in manual it will read shutter priority. ISO usually 1600 as Josh stated above.
